Unemployable Affiliate Program – Terms of Service

These Terms of Service ("Agreement") govern your participation in the Affiliate Program ("Program") offered by Unemployable ("Company," "we," "us," or "our"). By joining or participating in the Program, you ("Affiliate," "you," or "your") agree to comply with the following terms and conditions.
1. Program Enrollment
To enroll in the Program, you must:
Submit a complete application through our affiliate platform, Tapfiliate
Be 18 years of age or older
Operate a valid website, email list, social media profile, or marketing channel that aligns with our brand
We reserve the right to approve or reject any application at our sole discretion. Participation may be revoked at any time if you violate these terms.
2. Affiliate Responsibilities
As an Affiliate, you agree to:
Promote Unemployable in an ethical, transparent, and brand-aligned manner
Comply with all applicable laws, including FTC disclosure requirements
Avoid spam, misleading claims, or aggressive sales tactics
Not impersonate the Unemployable brand or mislead users into thinking you're an employee or official partner
Not run paid advertising targeting our branded terms (e.g., “Unemployable apparel”)
Failure to comply may result in termination and forfeiture of unpaid commissions.
3. Commissions and Payouts
Commission Rate: 20% on net referred sales (excluding taxes, shipping, discounts, returns, and chargebacks)
Payout Method: PayPal (you must provide a valid PayPal email)
Payout Schedule: Monthly, on or around the 15th
Minimum Payout Threshold: $50 USD
We reserve the right to adjust the commission rate or payout terms at any time with written notice. Commissions earned through self-referrals or fraudulent activity are void.
4. Term and Termination
This Agreement begins upon acceptance and continues unless terminated.
We may terminate this Agreement at any time, with or without cause. Grounds for immediate termination include:
Brand misrepresentation
Fraudulent or unethical conduct
Violation of intellectual property or these terms
Upon termination, access to your affiliate account and unpaid commissions (if earned through prohibited means) may be revoked.
5. Intellectual Property
Affiliates are granted a non-exclusive, non-transferable, revocable license to use our approved brand materials solely for promotion. You may not:
Modify or distribute Unemployable brand assets
Use the logo or name in domain names or social handles
Misrepresent yourself as the brand or owner of the products
All intellectual property remains the sole property of Unemployable.
6. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages (including loss of earnings or data). Our total liability under this Agreement shall not exceed commissions paid to you in the previous 90 days.
We make no guarantees about affiliate income or sales performance.
7. Independent Contractor Status
You are an independent contractor, not an employee, agent, or partner of Unemployable. You are responsible for reporting and paying all applicable taxes related to your affiliate earnings.
8. Agreement Modifications
We reserve the right to change or update this Agreement at any time. Changes will be posted in your affiliate dashboard and/or emailed. Continued participation in the Program constitutes acceptance of the revised terms.
9. Governing Law
This Agreement is governed by the laws of the State of Utah, United States. Any disputes will be resolved in the courts located in Utah County, Utah.
